Thank you for booking a birthday party package with the Town of Essex. Below is a list of terms and conditions which must be accepted prior to confirmation of booking. Should you have any questions, feel free to contact the Facility Clerk for further information.
Aquatic Admission Policy(s) will be strictly adhered to - please ensure you read and understand all details below.
Outside/Additional Food and Beverage Products
Due to staffing and material resources included in your rental, outside food and/or beverages are not permitted during this booking without prior written approval. This may incur additional costs.
Cake and ice cream is not included in this policy.
Conditions of Use
1. Absolutely no one shall be allowed in the pool area until the supervising lifeguard is present. Anyone not complying with this rule will be expelled from the premises.
2. Keys for locker rentals may be obtained at the reception counter for a charge of $1.00 with a $4.00 deposit.
3. The Town of Essex reserves the right to cancel a rental. If a cancellation is required, the licensee will be notified as to the reason for such cancellation, and attempts will be made to try to reschedule the party. No charge will be assessed to the licensee for pool time that cannot be rescheduled.
4. Charges will apply if:
- There is willful damage caused on the premises.
- Participation numbers of adults and children exceeds original party booking package.
- The rental party does not show up or does not provide a valid reason why they could not use the time. Charges will be 100% of the rental total.
5. Additional charges will apply if:
- There is willful damage caused on the premises.
- Any additional supplies or equipment is used which was not included in the original booking package.
6. The licensee shall be bound to obey and follow all aquatic policies posted throughout the Complex, enforced by the staff, and those listed in the contract. Those found to be breaking these rules shall be subject to their contract being cancelled at once.
7. Decorations and signage may only be secured to walls/doors with non-residual tape (e.g. painters’ tape). Duct tape, electrical tape, scotch tape or other tapes that leave any residue are not permitted.
8. The size of party booked should reflect the TOTAL number of participants attending, including all adults, both in the pool and room/gym.
Cancellation Policy
Group One:
- Group One is defined as a user that rents one or more regular hourly bookings per week.
- Groups will be allowed to cancel rental time that is not required but must do so seven days in advance of the rental times and will be charged 50% per hour of cancelled rental time unless the time is rebooked by the Town of Essex. Cancellations of less than seven days will not be accepted.
- Rental time may only be cancelled at the beginning or end of the rental time (For example: The original rental was from 7:00 p.m. to 10:00 p.m. and the group wants to cancel one hour, they must cancel either 7:00 p.m. to 8:00 p.m. or 9:00 p.m. to 10:00 p.m.);
- Subletting of rental time will not be allowed; and
- Groups will be set up on schedule payments due the 1st day of each month. Credit Cards/EFT/Post-Dated Cheques may be used for payments.
Group Two:
- Group Two is defined as a User Group that does not book regular rental time.
- Group Two Users must make payment in full for their rental time at the time of booking: and
- If the user chooses to cancel their rental time prior to fourteen business days in advance of the rental, they will receive a full refund/credit. If they cancel less than 14 business days in advance, they will be charged 50% of rental fee. If they cancel with less than three days, they will be charged 100% of rental fee.
Aquatic Admission Policy
1. Parents and guardians are those who are a minimum of 14 years of age, and who are responsible for the direct supervision of those they are accompanying. Direct supervision means within arms reach, in the water, and in proper swim attire (bathing suit only, T-shirts or other clothing are not permitted).
- 6 years old and under = always accompanied, max of 2 swimmers
- 7 to 13 years, NOT ABLE to pass swim test = always accompanied, max of 2 swimmers
- 7 to 13 years, able to pass swim test = may swim unaccompanied
2. Parents and guardians are responsible for all children under the age of 10 while in our facilities, and must supervise them at all times.
3. High-risk participants must be in a ratio of 1:1. The Town of Essex requires that high-risk participants (those with serious medical conditions such as seizures, frequent fainting or those with uncontrolled behaviours or impulses) be accompanied by an individual knowledgeable of the condition and responsible for their direct supervision. It is also suggested that those with seizure disorders wear a lifejacket or PFD at all times. PFDs are available free of charge.
4. Those aged 7 years and older may swim unaccompanied if they can prove proficiency by swimming widths of the lap pool (approximately 20m) unassisted, and tread water for 30 seconds
Water Slide
1. All sliders must meet the Aquatic Admission Policy as stated above and be 1.2 m or taller.
2. Children are not permitted to ride down the slide with another person. Only one person is permitted down the slide at a time.
3. Flotation devices of any kind (water wings, lifejackets etc.) are not permitted on the slide.
4. All sliders must go down the slide feet first on their back or sitting up. Stomach or headfirst sliding is not allowed.
5. When entering the splash-down area sliders must swim directly to the stairs and climb out. Sliders are not permitted to climb out at the sides or swim under the lane ropes.
6. Parents or guardians are not permitted to catch children as they come off the slide or wait on the steps at the bottom of the slide.
Tarzan Rope
1. All participants must meet the Aquatic Admission Policy as stated above.
Training Pool Use
1. Children under the age of 12 must be accompanied by a guardian 16 years of age or older.
2. Enter and exit slowly. Headache and dizziness are signs to leave the water immediately.
3. 10-15 minutes may be excessive for some individuals. Limit time and cool down periodically.
4. Do not use the pool if you have an open sore or rash, or are experiencing nausea, vomiting or diarrhea.
5. Persons suffering from heart disease, diabetes, high/low blood pressure should consult their physician prior to use.
6. Pregnant women should consult their physicians prior to use.
7. Do not use pool under the influence of alcohol, antihistamines, anticoagulants, vasoconstrictors, tranquilizers, stimulants or narcotics.
As a participant, I accordingly acknowledge and agree that myself and/or my Child may suffer damages, personal injury, and even death. I freely and voluntarily assume all the risks and hazards of participation, including any legal risks. This means that I am giving up my right to sue the Town for any reasons including negligence, if my Child suffers any damage, injury, loss or death by participating in the Event
Release and Indemnification
You, as authorized representative of the Licensee, has read and on behalf of him/herself, the Licensee, and the Licensee’s members (collectively the “Releasors”), agrees to be bound, without reservation, by this contract and the terms and conditions contained herein and attached hereto, and hereby warrants and represents that he/she is at least 19 years of age, and executes this contract on behalf of the Releasors and has sufficient power, authority and capacity to bind the Releasors with his/her signature.
The Releasors, in consideration of this contract, acknowledges and agrees that the Town of Essex is not responsible for any personal injuries or property damage whatsoever that the Releasors, or any invitee thereof, may sustain or suffer by reason of the use of the Facility.
The Releasors hereby release and forever discharge the Town of Essex, its councillors, officers, employees, and agents [collectively the “Releasees” from all claims, demands, liabilities, actions or causes of action, including but not limited to personal injury, death, or damage to property (whether or not owned by the Releasors), which the Releasors or any other party may advance, howsoever arising out of the Releasors’ use of the Facility or from any non-compliance with, or a violation of, the terms of this contract. This release is binding upon the Releasors and their heirs, executors, administrators, and successors; and ensures to the benefit of the Releasees and their heirs, executors, administrators, successors, and assigns.
